Draft for review. This page was prepared in good faith and has not yet been reviewed by a qualified legal adviser. RECRUITERCLICK LTD will update it following that review.
Summary
- Candidates: we never charge you a fee for finding you work, so no refund is ever needed.
- Permanent placements: if a candidate leaves within the first 12 weeks, the employer may be entitled to a partial rebate of the placement fee.
- Temporary and contract workers: charges are for hours worked, so they are not refundable, but timesheet errors are corrected.
- IT services: refunds depend on the work completed and are set out in each project's written proposal.
This policy applies unless the written terms of business or project proposal agreed with you say otherwise. If they differ, the written agreement takes priority.
Candidates
We do not charge candidates any fee for registering with us, for introducing them to employers, or for finding them work. This includes reviewing CVs and any CV or application guidance we provide. Legislation governing recruitment businesses in Great Britain, including the 2003 Conduct Regulations (SI 2003/3319), restricts charging work-seekers for these services.
If anyone claiming to represent RECRUITERCLICK LTD asks you for payment to secure a job, do not pay. Report it to us at info@recruiterclick.com.
Permanent recruitment rebates
Placement fees for permanent roles are payable by the employer as set out in the written terms of business. If a candidate we introduced leaves, or is dismissed, within the rebate period, the employer is entitled to a rebate of the fee paid, on the following scale:
| The candidate's employment ends | Rebate of the placement fee |
|---|---|
| Within the first 4 weeks of starting | 80% |
| In weeks 5 to 8 | 50% |
| In weeks 9 to 12 | 20% |
| After 12 weeks | No rebate |
Instead of a rebate, the employer may ask us to search for a replacement candidate for the same role at no additional fee, provided this is requested within the same period.
Rebate conditions
A rebate or free replacement applies only if:
- the placement fee was paid in full within the agreed payment terms;
- the employer tells us in writing within 7 days of the candidate's employment ending;
- the employment did not end because of redundancy, restructuring, a change to the role, salary or working arrangements, or a breach of employment law or of the employment contract by the employer;
- the candidate was not dismissed for a reason the employer knew about, or could reasonably have identified, before making the offer;
- the employer did not re-engage the candidate, directly or through another party, within 12 months.
No rebate applies where an offer is withdrawn by the employer, or where the employer engages a candidate we introduced in a different role or at a later date. In those cases the fee in the terms of business remains payable.
Temporary and contract workers
- Charges for temporary and contract workers are based on hours or days worked, as recorded on authorised timesheets. Charges for time worked are not refundable.
- If a timesheet or invoice is wrong, tell us within 14 days of the invoice date and we will correct it and issue a credit or refund for any overpayment.
- If a worker is unsuitable, tell us within the first 4 hours of their first assignment. We will not charge for those hours and will try to provide a replacement.
- Any fee for taking a temporary or contract worker into a permanent role, or the alternative of an extended period of hire, is set out in the terms of business, as the 2003 Conduct Regulations require.
Job posting and campaign support
- Job posting: if you cancel before an advert is published, any amount you have paid is refunded in full. Once an advert has been published, the fee is not refundable, because the service has been delivered.
- Recruitment campaign support: fees are charged for the stages agreed in writing. If you cancel a campaign, you pay for the work completed up to the date of cancellation, and any amount paid in advance for work not yet started is refunded.
IT services
- Each project has a written proposal or statement of work setting out the scope, milestones, price and payment schedule.
- Deposits cover initial planning and scheduling. If you cancel before work starts, the deposit is refunded less any costs we have already incurred on your behalf, such as third-party licences or domain registrations.
- Cancellation during a project: you pay for work completed and approved milestones up to the date of cancellation. Payments made in advance for work not yet started are refunded.
- Defects: if delivered work does not match the agreed specification, tell us within 30 days of delivery and we will fix it at no extra charge. If we cannot fix it within a reasonable time, we will agree an appropriate price reduction or refund for the affected part.
- Third-party costs such as hosting, software licences and domain names follow the provider's own refund terms.
- Maintenance and support plans can be cancelled with the notice period in the agreement. Unused months paid in advance are refunded.
If you are a consumer
Our services are mainly provided to businesses. If you buy a service from us as an individual for personal use, you also have rights under consumer law, which this policy does not limit:
- Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you agree a service with us online, by phone or by email, you can usually cancel within 14 days of the contract being made. If you ask us to start work within those 14 days, you will pay for the work done up to the point you cancel.
- Under the Consumer Rights Act 2015, services must be carried out with reasonable care and skill. If they are not, you can ask us to put things right, and if that is not possible, you are entitled to a price reduction.
